PARTICIPANT WAIVER

Elite Baseball & Softball Training Liability Waiver & Release

Please read this waiver carefully. Signing it — at online registration, on paper at the facility, or by completing payment — is legally binding for the participant and (if a minor) the parent or legal guardian.

Effective May 2026

This waiver releases Elite Baseball & Softball Training, Inc. from certain legal claims and confirms your assumption of the inherent risks of athletic participation. Read every clause. Ask questions before signing. If you do not agree to any term, the participant may not take part in Elite programs.

Acknowledgment & Assumption of Risk

Participation in baseball, softball, strength training, and related activities at Elite involves inherent risks — physical injury (strains, sprains, fractures, dislocations, concussions), being struck by balls, bats, or equipment, slips, falls, collisions, equipment failure, and exposure to communicable diseases. These risks may cause serious injury, permanent disability, or death.
I voluntarily assume full responsibility for all loss, property damage, illness, or personal injury sustained from the participant's involvement in any Elite training session, program, camp, league, team activity, drop-in clinic, evaluation, or facility use.
If signing as a parent or legal guardian, I represent that I have the legal authority to assume these risks on behalf of the minor participant.

Release of Liability

I release, waive, discharge, and hold harmless Elite Baseball & Softball Training, Inc, and its owners, officers, employees, coaches, contractors, affiliates, successors, and assigns (collectively, the 'Released Parties') from any and all liability, claims, demands, lawsuits, costs, and expenses arising from the participant's involvement with Elite — including claims based on ordinary negligence. This release does NOT apply to gross negligence, willful misconduct, or intentional acts as defined by Michigan law.

Indemnification & Hold Harmless

I agree to indemnify, defend, and hold harmless Elite Baseball & Softball Training, Inc, and the Released Parties from any and all third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from the participant's actions, omissions, or conduct while at Elite or in connection with any Elite program. This obligation survives the termination of the participant's enrollment.

Medical Consent & Concussion Awareness

I certify the participant is physically able to participate. In an emergency, I authorize Elite staff to administer first aid, call 911, and authorize medical transport if I cannot be reached. I am responsible for all medical expenses; Elite does not provide coverage. Per Michigan Public Act 343 of 2012, I acknowledge receipt of concussion education — any athlete suspected of head injury is removed from activity and may not return without written clearance from a qualified medical provider.

Photo & Media Release

Scope of License

Perpetual — the license remains in effect indefinitely
Worldwide — usable in all geographic regions
Royalty-free — no royalties or per-use fees owed
Irrevocable — cannot be withdrawn once granted

Inspection Rights

I waive any right to inspect or approve the finished media before publication.

Compensation

None

No payment, royalty, or other consideration will be provided for any use.

Video and motion recordings
Audio recordings and voiceovers
Derivative works such as composites, edits, and highlight reels

Authorized Distribution Channels

Website, social media, and digital content
Marketing, advertising, and promotional materials
Print collateral, signage, and press releases
Internal training, analytical, and educational use

Survival & Assignment

This release survives the termination of the participant's enrollment with Elite and is binding on the participant's heirs, executors, and assigns. Elite may assign or license these rights to authorized third parties for the purposes listed above.

Acknowledgments

By accepting this release, I confirm the following:

The use of the participant's likeness may continue indefinitely
No compensation or royalties will be paid for any use of recordings
I have read and understood the full scope of this media license
I am authorized to grant this release on my behalf or as parent/guardian

Code of Conduct, Payment & Governing Law

Participant will follow facility rules and staff instructions, respect coaches and athletes, and use equipment properly. Elite may remove any participant for unsafe conduct without refund. Program fees are due at registration; missed sessions are non-refundable. This waiver is governed by Michigan law with venue in Kent County, binds the participant's heirs and assigns, and is the entire agreement on this subject. If any provision is unenforceable, the rest remains in effect. Electronic signatures are valid under E-SIGN Act and Michigan UETA.
